Information prior to reporting
Given the circumstances and information available at the time of reporting, the reporting person should have good reason to believe that the facts reported or disclosed are authentic and true. Therefore, it is not possible to report facts that are knowingly false. Such conduct may be subject to sanctions.
When obtaining documents supporting the reported facts, the reporting person should not engage in conduct that could constitute a criminal offense. The reporting person should act in the public interest and in good faith that the report is based on credible facts and information.
The whistleblower should also be able to identify the areas to which the unlawful conduct relates and consider what verifiable information they can provide about the reported unlawful conduct. The scope and quality of the information provided may have a positive impact on how the report is investigated.
Reports may also be made anonymously
In the case of anonymous reporting, the anonymous reporter does not enjoy protection under the Whistleblower Protection Act until their identity is revealed. The obligated entity is required to deal with anonymous reports and to proceed in accordance with the provisions of Act No. 171/2023 Coll. on the protection of whistleblowers when processing reports. In the case of an anonymous report, it is also useful to provide a telephone number or email address through which the whistleblower can be contacted while maintaining anonymity. The inability to contact the whistleblower may negatively affect the investigation of the report.
